This Policy explains how we collect, use, share, and protect information when you visit our website, subscribe to our newsletter, communicate with us (including by SMS/text), or otherwise interact with BuildTerra Capital. We provide construction loan brokerage and consulting services to business entities; we are not a direct lender or consumer lender.

1) What we do

We identify and qualify home builders, land developers, and related businesses that may need construction financing. We consult with them on business planning and activities related to residential land development and ground up construction buildings or community projects (like townhomes, condominiums and single family homes).  Our consulting services provide valuable information, guidance and opinions related to construction loans, business and project planning, project budgets, risk identification, planning and mitigation, and, with their authorization, we connect them to appropriate lenders and loan products. We do not extend credit or make underwriting decisions.

2) Information we collect

We strive to minimize the information we collect via this website.

  • Website & device data (from visitors): IP address, device/ browser type, pages visited, referring URLs, and basic analytical data collected via cookies or similar technologies. See Cookies & analytics below.

  • Contact & preference data (from prospects or subscribers): your name, business name, email address, phone number, communication preferences, and the content of messages you send us (e.g., via a contact form or newsletter signup).

  • Business application data (from clients): when you engage us to help prepare third‑party lender applications for your business, our team may collect and process application materials you provide (e.g., entity documents, project budgets, financials). We do not intentionally collect consumer/household financial information via this public website.

  • SMS/Text messaging data: your phone number, opt‑in/opt‑out status, message content, timestamps, and delivery information when you communicate with us by text (details in SMS & Text Messaging below).

 

We do not knowingly communicate with or collect information from children under 13, nor do we offer services to individuals under 18.

3) How we use information

We use information to:

  • Provide, operate, and improve our website and services;

  • Communicate with you, including sending meeting reminders or scheduling links (email or SMS);

  • Manage newsletter subscriptions and other communications you request;

  • Perform due diligence and prepare business financing applications you authorize us to submit to lenders;

  • Comply with legal obligations and enforce our agreements; and

  • Protect the security and integrity of our systems.

 

We do not use SMS/text to request or transmit sensitive personal or financial information. Please do not send such information by text.

4) Sharing of information

We share information only as described below:

  • With service providers that host or process data for us (e.g., secure cloud storage such as Dropbox, OneDrive, or Google Drive; communications platforms such as RingCentral or Zoom; Customer Relationship Management (CRM) systems such as HubSpot, Pipedrive or Zoho; email providers). These parties are contractually obligated to protect your information and use it only for our instructions.

  • With 3rd party lenders you explicitly authorize us to communicate with, as your advocate, agent and/or representative, after you approve a term sheet and choose to proceed with an application with said lender. We provide the 3rd party lender with application and project related materials on your behalf, and which you exclusively authorize us to share. We may also assist you in completing a lender's own application, and periodically may refer you to communicate with a 3rd party lender directly. 

  • For legal reasons when required to comply with law, regulation, legal process, or to protect rights, property, or safety.

  • Business transfers in connection with a merger, acquisition, or asset sale (your information would remain subject to this Policy or a successor policy of equal or greater protection).

 

We DO NOT sell personal information and we do not share it for cross‑context behavioral advertising.

We DO NOT share your opt-in consent to receive SMS & Text Messaging, Email Subscriptions or other similar information with any 3rd party lender or other entity. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5) Data retention

We retain information only as long as necessary for the purposes described here or as required by law, regulation, or contract. Retention periods may vary for client/lender records, tax/transaction records, and communications logs.

6) Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect information (including access controls, role‑based permissions, encryption in transit, and secure cloud storage). No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7) Cookies & analytics

We may use first‑party and third‑party cookies or similar technologies to operate the site and measure usage. You can control cookies through your browser settings. If you block certain cookies, site features may not function properly. We currently do not respond to Do Not Track signals.

8) Your choices & rights

  • Email & newsletter: You can unsubscribe at any time via the link in our emails or by contacting us.

  • SMS/Text: See SMS & Text Messaging for opt‑in/opt‑out details. Consent to receive texts is not a condition of purchase or service.  You may reply STOP at any time via SMS & Text Messaging to opt out of further messaging. Reply HELP for more information.

  • Access, correction, deletion: If you are a U.S. resident and wish to request access to, correct, or delete information we maintain about you, contact us at records@build-terra.com. If you are a California resident, you may have additional rights under the CCPA/CPRA. We do not sell personal information.

Our services are intended for U.S. businesses. If you visit from outside the U.S., you consent to the processing and transfer of your information in the United States.

SMS & Text Messaging Terms (A2P 10DLC)

 

These SMS Terms govern your enrollment in and use of BuildTerra’s text messaging communications. By opting in, you agree to these terms.

Program description. We send non‑marketing, service‑related messages such as meeting reminders, scheduling links (e.g., Microsoft Teams), and simple status updates. We do not request or transmit sensitive personal or financial information by SMS.

Opt‑in. You may opt in by submitting a website form that includes a clear SMS consent checkbox; by texting a keyword we provide; by providing your Mobile Number in a required field; or by otherwise providing written consent to receive texts from BuildTerra at your supplied number. Consent is not a condition of purchase or services.

Opt‑out. You can cancel at any time by replying STOP. After you send STOP, we may send one final message to confirm your opt‑out. To get help, reply HELP or contact records@build-terra.com.

Message frequency. Message frequency varies (typically only during active engagements).

Message & data rates. Msg & data rates may apply.

Supported carriers. Delivery may be subject to your mobile carrier’s policies. Carriers are not liable for delayed or undelivered messages.

Eligibility. You must be the subscriber or customary user of the phone number you provide and at least 18 years old.

Privacy. We use your phone number and messaging metadata to deliver texts and maintain opt‑in/opt‑out records. See our Privacy Policy for details. We do not sell personal information.

Changes. We may modify or suspend the SMS program at any time. Updates will be posted with a revised effective date.
