These Terms of Service (“Terms”) govern your access to and use of the BuildTerra website and any materials or communications we provide (collectively, the “Services”). By using the Services, you agree to these Terms.

2) Who we are & what we do

BuildTerra, LLC d/b/a BuildTerra Capital is a construction loan brokerage and consulting firm serving business entities (e.g., home builders and land developers). We are not a lender and we do not make credit decisions, issue commitments, or provide consumer loans. Any financing you obtain is issued by third‑party lenders subject to their underwriting and definitive agreements.

3) No offer or guarantee

Content on this site is for general information only and is not an offer, commitment, or advice to extend credit. Financing availability and terms are determined solely by lenders. Project outcomes, costs, timelines, and financing cannot be guaranteed.

4) Your responsibilities

You represent that you are authorized to act for your business and that any information you provide is accurate and lawful to share. You agree not to misuse the Services, including by attempting to disrupt, reverse‑engineer, or scrape the site; infringe intellectual property; or use the site for unlawful purposes.

5) Accounts & access

Our site may offer newsletter subscriptions and (optionally) customer login features. You are responsible for safeguarding any credentials and for all activities under your access. We may suspend or discontinue features at any time.

If you opt to receive SMS/text messages, the SMS & Text Messaging Terms above apply (STOP to cancel, HELP for help; message frequency varies; Msg & data rates may apply). Consent is not a condition of purchase.

7) Third‑party services & links

Our Services may integrate or link to third‑party platforms (e.g., Microsoft Teams, Dropbox, OneDrive, Google Drive, RingCentral). We do not control third‑party sites and are not responsible for their content, security, or policies. Your use of third‑party services is governed by their terms and privacy policies.

8) Intellectual property

All content on the site (text, graphics, logos, and other materials) is owned by BuildTerra, LLC ("BuildTerra") or its licensors and is protected by law. You may not copy, distribute, or create derivative works without our prior written permission, except as permitted by law for your internal business use.

9) Confidentiality; business application materials

If you engage BuildTerra, we will treat your non‑public business application materials as confidential and use them only to provide services to you and to transmit to lenders you authorize. Do not transmit sensitive personal or financial information by SMS/text.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR‑FREE OR UNINTERRUPTED.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDTERRA, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless BuildTerra, LLC and its personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Services or violation of these Terms.

13) Governing law & venue

These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Alachua County, Florida for any dispute not subject to informal resolution.

14) Changes

We may update these Terms from time to time. Changes are effective when posted with an updated effective date.
